The Vicksburg Post Saturday October 26 2013 A3 STATE Judge mulls insurer's request to block Gov order JACKSON (AP) A federal judge says he intends to rule on Monday in a dis pute between largest health insurer and Gov Phil Bryant US District Judge Henry Wingate heard arguments riday in a lawsuit Blue Cross Blue Shield of Mississippi filed to try to block an executive order that Bryant issued Tuesday order would make Blue Cross resume paying in network rates at hos pitals owned by Health Management Associates Blue Cross says the governor have the power to dictate terms of a con tract between two private companies asking Wingate to issue a temporary restraining order which would allow the insurer to ignore command Bryant ordered the hospitals returned to Blue network by Oct 29 The governor said that without the hospitals Blue Cross would have an insufficient net work under state law Insurance Commissioner Mike Chaney opposes execu tive order saying it ille gally usurps his power and the power of the state Department of Insurance John Corlew an attor ney representing Chaney said in court riday that voters elect Bryant to do the insurance com job have one man saying is the way going to Corlew said of Bryant Assistant Attorney General Harold Pizzetta who represented the gover nor responded: not trumping the The Mississippi Constitution gives the governor as chief executive officer the power to make sure all state laws including insurance laws are faith fully carried out Pizzetta said Blue Cross and HMA are involved in a lengthy dispute over money HMA based in Naples la owns 10 hospitals in Mississippi It filed a $13 mil lion lawsuit in June against Blue Cross saying that the lowood based insurance company broke contract terms by under paying for procedures Blue Cross has said HMA overcharges The lawsuit is still pending Several days after the lawsuit was filed Blue Cross gave notice that it was ending its contract with HMA at the end of August That meant that starting Sept 1 the HMA hospitals were out of net work for people with Blue Cross coverage meaning patients eventually could face higher out of pocket expenses The' HMA hospitals have said however that covering the difference between in net work and out of network costs rather than passing those costs on to patients Blue Cross said this past Monday that it would start paying in network rates at four of the 10 HMA hospitals: Gilmore Memorial Regional Medical Center in Amory Northwest Mississippi Regional Medical Center in Clarksdale Tri Lakes Medical Center in Batesville and Wom Hospital in lowood execu tive order covering the Blue Cross HMA relationship at all 10 hospitals came the next day David Kaufman an attorney represent ing Blue Cross said in court riday that HMA has a panic with misin by holding rallies issuing press releases and persuading lawmak ers to hold a hearing to make people think patients will lose access to health care because of the contract dispute one is being denied access to medi cal Kaufman said At the hearing in mid September a neo natologist said that if HMA hospitals close there would be too few labor and delivery rooms or surgery rooms to handle the number of births in the Jackson area She said that could lead to women going through labor or even giving birth in hall ways at other hospitals Governor Phil Bryant ondling trial set for Tupelo ricin suspect JACKSON (AP) The man charged with sending poison laced letters to President Barack Obama and other officials is scheduled for trial in November on unrelated fon dling charges James Everett Dutschke a former martial arts instructor from Tupelo is charged in federal court with sending ricin tainted letters on April 8 to Obama US Sen Roger Wicker and Lee County Justice Court Judge Sadie Holland charged in Lee County with three fondling charges The fondling case is set for trial Nov 19 The April 1 indictment accuses Dutschke of improperly touching three girls under the ages of 16 in alleged incidents from January 2007 through Jan 16 2013 He was free on $25000 bond until federal agents arrested him April 27 on the poison letter charges In the ricin case he has pleaded not guilty to five counts and denies sending the letters His trial on the ricin charges is pending until further order from the court after his lawyer asked for more time to prepare ederal the exhuma tion of the body of an unidentified woman who was hit by a vehicle and killed in south Mississippi in 1998 Relatives of Nelda Louise Hardwick of Lake Charles La believe she is the one buried as Jane Doe in St Joseph Cemetery in coastal Hanco*ck County which borders Louisiana Hardwick went miss ing in 1993 Hanco*ck County Circuit Court Judge Lisa Dodson issued the order in a ruling riday saying DNA may determine the true identity Hanco*ck County Coroner Jim aulk who petitioned to have the body exhumed is among those who believe Jane Doe is Hardwick Three of relatives identified
